MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain mortgage dated the 8th day of March, 2006, by Bernardo Quintero, a single man, to First National Bank of Jasper recorded in the office of the Judge of Probate of Winston County, Alabama, in MORT BK 486, PG 233 as corrected by Scrivener’s Affidavit recorded at Deed BK 286 PG 879 in the aforesaid Probate Court. Subsequently, said mortgage was transferred by Synovus Bank, a Georgia banking corporation, (a/k/a First Bank Jasper Div Synovus Bank) formerly known as Columbus Bank and Trust Company, as successor in interest through name change and by merger with First National Bank of Jasper, to RH AL, LLC, an Oregon limited liability company, by assignment recorded in MORT BK 624, PG 426, in the aforesaid Probate Court. RH AL, LLC, as Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash in front of the entrance of the Courthouse in the City of Double Springs, Winston County, Alabama, on the 8th day of May, 2018, during the legal hours of sale, the following real estate situated in Winston County, Alabama, to wit:
Lot 5 of Longview Landing Subdivision, as recorded in Plat Book 3, Page 107, in the Probate Records of Winston County, State of Alabama.
Subject to the Restrictive Covenants of Longview Landing Subdivision as recorded in Deed Book 262, Page 851, in the Office of the Judge of Probate, Winston County, Alabama, as amended at Deed Book 262, Page 878.
Also, subject to easement to Alabama Power Company for water storage rights up to the 510' water level of Smith Lake, and for overflow rights up to the 522' water level as recorded in the Probate Office of Winston County, Alabama, including the exclusive jurisdiction to regulate the permitting of any dock located or sought to be located on the subject property.
Also, and subject to, a 40' easement for the purpose of ingress/egress to Lots 1-13 of Longview Landing Subdivision, recorded at Map Book 3, Page 107, in the Probate Records of Winston County, Alabama, also located in the SW 1/4 of Section 5, Township 12 South, Range 6 West, Winston County, Alabama. Said easement being 20' on each side of the centerline of a road more particularly described as follows:

This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances and exceptions reflected in the mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described property is situated.
This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
This sale is made for the purpose of paying the indebtedness secured by the said mortgage, as well as the expenses of foreclosure.
