NOTICE OF SALE UNDER POWER
FORECLOSURE NOTICE
WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a mortgage from JACKIE L. SWANIGAN MARRIED, KATIE M. DEMPSEY, MARRIED, to DITECH FINANCIAL LLC, on the 17th day of November, 2016, said mortgage recorded in the Office of the Judge of Probate of Winston County, Alabama, on December 19, 2016, in Deed/Mortgage Book 613, Page 702-705 , Winston County, Alabama Records, said Mortgage having subsequently been transferred and assigned to U.S. Bank, N.A., as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee, successor by merger to First Union National Bank as Trustee, for Mid-State Trust VII, by instrument recorded in the aforesaid Probate Office; notice is hereby given that the undersigned U.S. Bank, N.A., as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee, successor by merger to First Union National Bank as Trustee, for Mid-State Trust VII, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash in front of the main entrance of the Courthouse in Double Springs, Winston County, Alabama, on December 10, 2020, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Winston County, Alabama, to-wit:

OF A PAVED COUNTY ROAD, THENCE NORTH 86 DEGREES 52 MINUTES 29 SECONDS EAST 189.95 FEET TO A 1/2 INCHES REBAR, ON SAID R.O.W., THENCE SOUTH 12 DEGREES 21 MINUTES 12 SECONDS WEST 279.45 FEET TO A 1/2 INCHES REBAR, BACK TO THE POINT OF BEGINNING, CONTAINING 1.00 ACRES MORE OR LESS. SAID LAND LYING IN THE NE 11/4 OF THE NW 1/4 OF SECTION 10, TOWNSHIP 12 SOUTH, RANGE 6 WEST, WINSTON COUNTY, ALABAMA.
Said legal description being controlling, however the property is more commonly known as 8961 CNTY RD 12, ARLEY, AL 35541.

This property will be sold subject to the right of redemption of all parties entitled thereto and subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable). This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure. The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate. This sale is subject to postponement or cancellation.
