Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Randy Lee Gates and wife, Judith Ann Gates, originally in favor of Jim Walters Homes, Inc. on September 8, 1996, said mortgage recorded in the Office of the Judge of Probate of Winston County, Alabama, at Book 357, Page 204; the undersigned U.S. Bank, N.A., as Trustee, successor in interest to Wachovia Bank, National Association, as Trustee, successor by merger to First Union National Bank as Trustee, for Mid-State Trust VII, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash or certified funds, in front of the main entrance of the Courthouse at Winston County, Alabama, on February 25, 2021, during the legal hours of sale, all of its right, title, and interest in and to the following described real estate, situated in Winston County, Alabama, to-wit:
A 3.0 acre, more or less, tract of land lying in the West 1/2-NW-1/4-SE 1/4 of Section 1, Township 10 South, Range 10 West, Winston County, Alabama, and being more particularly described as follows: Commence at the SW corner of said W 1/2- NW 1/4 -SE 1/4 and run thence east along the south boundary thereof 420 feet to the point of beginning; thence east along said south boundary line 240 feet; more or less, to the SE corner of W 1/4-NW 1/4-SE 1/4; run thence north along the east boundary thereof 440 feet, more or less, to an iron pin; run thence west 240 feet, more or less, to an iron pin; run thence south 440 feet, more or less, to the point of beginning. Said lands being the south 3 acres, more or less, of the land deeded to Linda Clark from Harold Clark, January 19, 1989.
