MORTGAGE
FORECLOSURE SALE
WHEREAS, default has occurred in the performance of the covenants terms and conditions of that mortgage from Charles Banks, a married man, to BankFirst Financial Services, successor by merger to Traders and Farmers Bank, dated April 28, 2003 and recorded in the Office of the Judge of Probate of Winston County, Alabama on May 16, 2003, in Mortgage Volume 440 at Page 440; and
ALSO, that certain Mortgage from Charles Banks, a married man, to BankFirst Financial Services, successor by merger to Traders and Farmers Bank, dated January 23, 2004 and recorded in the Office of the Judge of Probate of Winston County, Alabama on February 6, 2004, in Mortgage Volume 452 at Page 926;
ALSO, that certain Mortgage from Charles Banks, a married man, to BankFirst Financial Services, successor by merger to Traders and Farmers Bank, dated December 16, 2014, and recorded in the Office of the Judge of Probate of Winston County, Alabama on December 22, 2014, in Mortgage Volume 593 at Page 996;
BankFirst Financial Services, successor by merger to Traders and Farmers Bank, as mortgagee, having declared all of the indebtedness secured by said mortgage due and payable and such default continuing, notice is hereby given under and by virtue of the power of sale contained in said mortgage, that BankFirst Financial Services, successor by merger to Traders and Farmers Bank, as mortgagee, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Double Springs, Winston County, Alabama during the legal hours of sale (between 11 a.m. and 4 p.m.) on the 15th day of November, 2022, the following property, situated in Winston County, Alabama together with hereditaments and appurten- ances there unto belonging and all buildings, structures, fixtures and other improvements now or hereafter existing, erected or installed thereon to-wit:

BEGINNING BEING IN LOT 10 IN PLAT BY R.L. BLANTON SAID PLAT BEING ON RECORD IN THE PROBATE JUDGE OF
WINSTON COUNTY OFFICE. DEED BOOK 28 AT PAGE 36 & 37 IN BEING PART OF SW ¼ OF SE ¼ SECTION 29, TOWNSHIP 9, RANGE 10 WEST, WINSTON COUNTY,
ALABAMA.
ALSO: TO GET A STARTING POINT, WE GO 225 FEET WEST ON THE NORTH SIDE OF HIGHWAY #5 FROM THE S.E. CORNER OF LOT #10, IN THE R.L. BLANTON PLAT OF THE SW ¼ OF SE ¼,
SECTION 29, TOWNSHIP 9, RANGE 10 WEST, WINSTON COUNTY,
ALABAMA THENCE 25 WEST FEET ALONG SAID HIGHWAY, THENCE NORTH 325 FEET TO A DITCH, THENCE RUNNING A NORTH DIRECTION ALONG ON EAST SIDE OF SAID DITCH 276 FEET, THENCE EAST, ALONG THE LINE OF CRUMPTON AND HOWELL AS OF DECEMBER 30, 1948, 130 FEET, TO THE ARMSTRONG LAND AS OF
DECEMBER 30, 1948, THENCE SOUTH ALONG SAID LINE 350 FEET, THENCE WEST 225 FEET, THENCE SOUTH 150 FEET TO POINT OF
BEGINNING.

BEGINNING AT THE SE CORNER OF LOT 10, AS OF PLAT MENTIONED ABOVE, THENCE GOING WEST ALONG ON NORTH SIDE OF SAID HIGHWAY 125 FEET, THENCE NORTH 150 FEET, THENCE EAST 125 FEET TO THE
ARMSTRONG LINE, THENCE SOUTH 150 FEET BACK TO POINT OF BEGINNING.
Said legal description being controlling, however the property is more commonly known as 2210 21ST Street, Haleyville, Alabama 35565;
Parcel ID 67-05-09-29-4-201-022.000.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, and any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record, including, but not limited to, those superior to said mortgage first set out above.
Said property will be sold on an “AS-IS” basis without any representation, warranty or recourse against the above-named or the undersigned. This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure. This sale is subject to postponement or cancellation.
