Default having been made on the terms of that certain mortgage executed by Justin Daniel Valentine, an unmarried man, to First National Bank on the 31st day of January, 2024, and recorded in Mortgage Book 2024, Page 815 in the Office of Judge of Probate of Winston County, Alabama, and default still continuing and by virtue of the power of sale contained in said mortgage, the following described real estate situated in the County of Winston, State of Alabama, will be sold at public auction to the highest bidder for cash at the Main Entrance of the Courthouse of Winston County, Alabama, during the legal hours of sale on the 9th day of January, 2025.
Commence at an iron pin found and purported to be the Southeast corner of the Northwest ¼ of the Southeast ¼ of Section 29, Township 10 South, Range 10 West, Winston County, Alabama; thence along a painted line North 4 degrees, 03 minutes, 46 seconds West 485.07 feet to an iron pin set the point of beginning for the property herein descried, thence South 55 degrees, 02 minutes, 45 seconds West 190.71 feet to an iron pin set, thence North 28 degrees, 42 minutes 34 seconds West 279.01 feet to an iron pin set on the South margin of County Road 17, thence along said margin as follows: thence North 56 degrees, 08 minutes, 40 seconds East 66.43 feet to a point, thence North 57 degrees, 14 minutes, 43 seconds East 85.34 feet to a point, thence North 58 degrees, 02 minutes, 09 seconds East 96.85 feet to a point, thence North 58 degrees, 20 minutes, 45 seconds East 69.84 feet to an iron pin set on said margin and on said painted line, thence leaving said margin South 4 degrees, 03 minutes, 46 seconds East 307.32 feet to the point of beginning and containing 1.6 acres more or less.
THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS, ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE-DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
Said sale will be made for the purpose of paying the mortgage indebtedness and costs of foreclosure.
