NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made under the terms of that certain mortgage executed by Jed Hyche, a married man, on the 17th day of February, 2010 to First National Bank of Jasper, which said mortgage is recorded in the Probate Office of Winston County, Alabama, in Mortgage Book 543, at Page 846, as assigned to Amos Financial, LLC, on the 27th day of June, 2018 by Synovus Bank (f/k/a First National Bank of Jasper), said assignment is recorded in the Probate Office of Winston County, Alabama, in Mortgage Book 629, at Page 284, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, Amos Financial, LLC, will sell at public outcry, for cash, to the highest bidder before the main entrance of the Courthouse in the City of Double Springs, Winston County, Alabama, during the legal hours of sale on November 13, 2019 the following described real estate situated in Winston County, Alabama, to-wit:
A parcel of land being the East 34.5 acres of the Southwest ¼ of the Southeast ¼ of Section 11, Township 10 South, Range 8 West, Winston County, Alabama.
A parcel of land being the West 5.5 Acres of that part of the Southeast ¼ of the Southeast ¼ of Section 11, Township 10 South, Range 8 West, Winston County, Alabama lying South of Lewis Smith Lake.
A parcel of land being the Northwest ¼ of the Northeast ¼ of Section 14, Township 10 South, Range 8 West, Winston County, Alabama.
Less and Except a parcel in the Southwest corner of said Northwest ¼ of the Northeast ¼ being 295 feet square.
Containing 38 acres more or less.
LESS AND EXCEPT FROM THE ABOVE THE FOLLOWING:
A parcel of land located in part of the SW ¼ of the SE ¼ of Section 11 and part of the NW ¼ of the NE ¼ of Section 14, all in Township 10 South, Range 8 West, Winston County, Alabama, and being more particularly described along the centerline as follows:
COMMENCE at the southeast corner of the SW ¼ - SE ¼ of Section 11, said point being a 5/8” capped rebar, and run N 01°27’20” E, along the east boundary of said SW-SE, a distance of 31.75’ to Point of Beginning and a point on the centerline of said 50’ wide driveway easement; thence S 53°24’32” W, along said centerline, a distance of 519.39’, to a point of curve; thence with a curve turning to the right, with an arc length of 104.95’, a radius of 400.00’, a chord bearing of S 60°55’31” W, and a chord length of 104.65’; thence with a reverse curve turning to the left, with an arc length of 169.19’, a radius of 182.14’, a chord bearing of S 41°49’50” W, and a chord length of 163.17’, to a point of tangent; thence S 15°13’09” W, along said centerline, a distance of 39.99’ more or less to the point of intersection with said centerline and the northeasterly right-of-way of Winston County Road #163; shortening and extending the sidelines as to terminate at the said right-of-way line of Winston County Road #163.
A parcel of land being the West 5.5 acres of that part of the Southeast ¼ of the Southeast ¼ of Section 11, Township 10 South, Range 8 West, Winston County, Alabama, lying South of Lewis Smith Lake.
Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said sale will be subject to the right of way easements and restrictions of record in the Probate Office of Winston County, Alabama, and will be subject to existing special assessments, if any, which might adversely affect the title to subject property.
Said property will be sold on an “As Is, Where Is” basis without warranty or recourse, express or implied as to title, use and/or enjoyment.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. An attorney should be consulted to help you understand these rights and programs as a part of the foreclosure process.
Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
The failure of any high bidder to pay the purchase price and close this sale shall, at the option of Mortgagee, be cause for rejection of the bid, and if the bid is rejected, Mortgagee shall have the option of making the sale to the next highest bidder who is able, capable and willing to comply with the terms thereof.
This sale is subject to postponement or cancellation.
THIS IS AN ACTION TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THIS PURPOSE.
