FORECLOSURE
Default having been made in the payment of the indebtedness secured by that certain mortgage dated January 20, 2006, executed by Rosemary O Benson and Ronnie L White, to Chase Bank USA, N.A., which mortgage was recorded on February 7, 2006, in Book 484, Page 481, of the mortgage records in the Office of the Judge of Probate of Winston County, Alabama and which mortgage was duly transferred and assigned to JPMorgan Chase Bank, National Association, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Winston County Courthouse at Double Springs, Alabama, during the legal hours of sale on November 28, 2023, the following described real estate, situated in Winston County, Alabama, to-wit:

A parcel of land described as follows: Commencing at the Southwest corner of the Southeast quarter of the Southwest quarter of Section 30, Township 11 South, Range 6 West and run North 2 degrees 45 minutes West along the West line of said quarter 313.34 feet to the point of beginning; thence North 15 degrees 05 minutes West 345.35 feet along Arley Manville Road and into the Southwest quarter of the Southwest quarter of Section 30, Township 11 South, Range 6 West; thence North 11 degrees 29 minutes West 247.60 feet; thence North 87 degrees 04 minutes East 111.55 feet to the West line of the Southeast quarter of the Southwest quarter; thence continue along the same course 1291.29 feet to the East line of said Southeast quarter of Southwest quarter; thence continue along the same course 130.00 feet into the Southwest quarter of the Southeast quarter of Section 30, Township 11 South, Range 6 West to an Old Fence Line; thence run in a Southerly direction along said Old Fence Line 905 feet more or less to the South line of the Southwest quarter of the Southeast quarter; thence South 87 degrees 14 minutes West 67 feet more or less to the Southeast corner of the Southeast quarter of the Southwest quarter; thence continue along the same course 274.65 feet to a branch and an old fence; thence run in a Northwesterly direction along said branch and old fence 1092.50 feet more or less to the point of beginning.
Less and Except any portion of subject property conveyed to William James Abercrombie and wife, Donnie Fay Abercrombie, by deed recorded in Volume 225, Page 676, Probate Records of Winston County, Alabama.
This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted.
Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
