NOTICE OF
FORECLOSURE SALE
Default having been made in the terms of that certain Mortgage, executed on October 1, 2021, by David Shortt, as Mortgagor, to Jack S. Kirkley and Reba H. Kirkley, as mortgagees, which said Mortgage is recorded at Mortgage Book 673, Page 251, and which said Mortgage and underlying promissory note is currently held by Philip Duke, and Philip Duke is authorized to enforce the terms of the Mortgage securing said promissory note by virtue of the power of sale thereunder and § 35-10-12, Ala. Code 1975, the following described real property will be sold at public outcry, for cash, to the highest bidder, in front of the Courthouse door of Winston County at 11:00 on 3/6/2026:
A parcel of land lying in the NW ¼ of the SE ¼ of Section 12, Township 12 South, Range 6 West, Winston County, Alabama, being more particularly described as follows:
Commence at the NW corner of the NW ¼ of the SE ¼ of said Section 12, said point being a drive shaft; and run N 89°40’00” E along the North boundary of said quarter-quarter a distance of 672.36 feet to a 5/8 inch rebar at the intersection with the easterly right-of-way of County Road 3936; thence run S 57°22’49” along the East boundary of said county road a distance of 64.01 feet to a point; thence run along the East boundary of said county road in a curve to the right having a radius of 362.00 feet, a length of 38.23 feet, a chord bearing of S 54°21’16” E and a chord distance of 38.22 feet to a point; thence run S 51°19’44” E along the East boundary of said county road a distance of 62.45 feet to a point; thence run along the East boundary of said county road in a curve to the right having a radius of 102.63 feet, a length of 91.48 feet, a chord bearing of S 25°47’38” E and a chord distance of 88.48 feet to a point; thence run S 0°15’32” E along the East boundary of said county road a distance of 112.38 feet to a 5/8 inch rebar; thence run S 31°43’39” E a distance of 295.98 feet to intersect with the 510 foot elevation line of Lewis Smith Lake; thence run the following bearings and distances along said 510 foot elevation line: N 11°33’25” E for 87.28 feet, N 1°46’31” W for 39.16 feet; N 1°46’31” W for 17.48 feet; N 31°50’17” E for 40.72 feet; N 21°44’01” E for 27.17 feet; thence leaving said 510 foot elevation line run N 11°26’21” W a distance of 90.11 feet to a 5/8 inch rebar; thence run N 0°19’59” W a distance of 251.19 feet to a 5/8 inch rebar; thence run N 78°39’31” W a distance of 8.94 feet to a 2 inch pipe; thence run N 89°35’36” W a distance of 94.48 feet to a drive shaft; thence run S 88°52’18” W a distance of 218.16 feet to the POINT OF BEGINNING. Said parcel contains 1.7 acres, more or less.
