LEGAL NOTICE OF HEARING OF
PETITION FOR VALIDATION OF OBLIGATIONS
TO: Taxpayers and Citizens of: (a) Winston County, Alabama and (b) City of Haleyville, Alabama
You are hereby given notice that The Health Care Authority of Haleyville and Winston County, Alabama (the “Authority”) has filed a Petition in the Circuit Court of Winston County, Alabama (67-CV-2020-900073.00) under Article 7 of Chapter 81 of Title 11 of the Code of Alabama 1975 requesting the Court to validate and confirm the following (as defined and described in the Petition): the Revenue Bonds, the Financing Documents, the taxes and means of payment of the Revenue Bonds, and the pledges, covenants and agreements made for the benefit of the Revenue Bonds. The Authority is a nonprofit public corporation organized pursuant to authorization and determination of the City of Haleyville, Alabama and Winston County, Alabama, under Articles 11 and 11A of Chapter 21 of Title 22 of the Code of Alabama 1975. The Revenue Bonds are limited obligations of the Authority payable solely from, and secured by a pledge of, the following local tax proceeds to be made available to the Authority for such purpose pursuant to the Financing Documents: (i) seventy-five percent of the proceeds of the ad valorem tax of two mills levied by Winston County, Alabama, within the boundaries thereof for public hospital purposes pursuant to Amendment No. 76 to the Constitution of Alabama of 1901, as amended; and (ii) the portion of the proceeds of the privilege license taxes levied by the City of Haleyville, Alabama, within the corporate limits thereof and dedicated to the Authority for payment of the Revenue Bonds pursuant to Ordinances No. 2017-12 and 2020-02 thereof. The Authority will use the proceeds of the Revenue Bonds for the corporate purposes thereof. Copies of the Financing Documents and Revenue Bonds, and the proceedings respecting the referenced taxes, are attached to the Petition.
You, as taxpayers and citizens of Winston County, Alabama, and of the City of Haleyville, Alabama, are required, pursuant to order of the Court, to show cause, if any you have, at a hearing of the Petition to be held at 1:30 p.m. on Tuesday, November 24, 2020, in the Bobby R. Aderholt Judicial Complex in the Town of Double Springs, Alabama, why the Revenue Bonds, Financing Documents, the taxes and means of payment of the Revenue Bonds, and the pledges, covenants and agreements made for the benefit of the Revenue Bonds, should not be validated and confirmed.
