MORTGAGE
FORECLOSURE NOTICE
Default having been made in the terms of that mortgage executed on April 28, 2003 by Michael T. Lively, a married man and wife Kelly H. Lively, to EvaBank, which said mortgage is recorded in Book 439, Page 768 in the Probate Office of Winston County, Alabama, and default continuing, and by virtue of the power of sale contained in said mortgage, the following described property will be sold at public outcry, for cash, to the highest bidder, in front of the Courthouse door of said County, in Double Springs, Alabama, during the legal hours of sale on October 16, 2024:
Lots No. 12, 13, 14, and 15 and the East 30 feet of Lot No. 11, in the Gibson Addition to the Town of Double Springs, Alabama, being a part of the NW ¼ of the SE ¼ of Section 29, Township 10 South, Range 8 West; ALSO, beginning at the NE corner of the SW ¼ of the SE ¼, thence South with the east boundary line of said forty a distance of 6 chains and 36 links to a certain stake; thence north of west 2 ½° parallel with north boundary line a distance of 4 chains and 59 links to a certain stake; thence north of west at an angle of 62 ½° a distance of 5 chains and 9 links to a certain stake; thence west of north at 15° angle 3 chains and 18 links more or less to a certain stake on the north boundary line; thence east 9 chains and 72 links more or less to the point of beginning, all in Section 29, Township 10 South of Range 8 West.
Except that part heretofore conveyed by Joe V. Robinson and wife to Henry McCullar.
Said sale is made for the purpose of paying the mortgage debt and cost of foreclosure.
