MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Donna M. Henderson to United States of America acting through the Farmers Home Administration, United States Department of Agriculture, dated January 20, 1995 said mortgage recorded in the Office of the Judge of Probate of Winston County, Alabama, in Book 341, Page 01. Said mortgage was subsequently sold, assigned and transferred to Secretary, United States Department of Agriculture, Rural Development. Under and by virtue of the power of sale contained in said mortgage, the undersigned, Secretary, United States Department of Agriculture, Rural Development, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse in Winston County, Alabama on November 12, 2024, during the legal hours of sale, all of its right, title, and interest in and to the following describe real estate situated in Winston County, Alabama, to-wit:
COMMENCING AT THE SW CORNER OF THE NE 1/4 OF SECTION 21, THENCE S-88 DEGREES 45'16”-E ALONG THE SOUTH LINE OF SAID QUARTER SECTION 829.63 FEET, THENCE N-00 DEGREES 06'46”- E A DISTANCE OF 332.78 FEE TO THE POINT OF BEGINNING, THENCE CONTINUE N-00 DEGREES 06' 46” A DISTANCE OF 210.00 FEET TO A POINT ON THE SOUTH RIGHT-OF-WAY OF COUNTY ROAD #8, THENCE N-77 DEGREES 52' 02”- E ALONG SAID RIGHT-OF-WAY A DISTANCE OF 135.00 FEET, THENCE S-00 DEGREES 06'48”-W A DISTANCE OF 210.00 FEET, THENCE S-77 DEGREES 52'02”-W A DISTANCE OF 135.00 FEET TO A POINT, SAID POINT BEING THE POINT OF BEGINNING. SAID LAND LYING AND BEING IN THE SW 1/4 OF THE NE 1/4 OF SECTION 21, TOWNSHIP 11 SOUTH, RANGE 8 WEST, WINSTON COUNTY, ALABAMA AND CONTAINING 0.83 ACRES, MORE OR LESS.

Said property will be sold "AS IS". NO REPRESENTATION OR WARRANTY, EXPRESSED OR IMPLIED, IS MADE AS TO THE TITLE OF SAID PROPERTY. Said property is subject to any title deficiencies including but not limited to: any outstanding ad valorem taxes - including taxes which are a lien but not yet due and payable, federal tax liens any matters which might be disclosed by an accurate survey and inspection of the property, any assessments liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Mortgage first set out above. Said property will be sold subject to the right of redemption of all parties entitled thereto. The highest bidder must tender the total amount of the winning bid in certified funds at the time and place of sale.
