NOTICE OF
FORECLOSURE
Default having been made in the payment of the indebtedness secured by that certain mortgage dated April 25, 2025, executed by Timothy West, Unmarried Man, As Sole Ownership, to Mortgage Electronic Registration Systems, Inc. solely as nominee for United Wholesale Mortgage, LLC, which mortgage was recorded on April 25, 2025, in MORT Book 2025, Page 2910 Instrument Number 202566, of the mortgage records in the Office of the Judge of Probate of Winston County, Alabama and which mortgage was duly transferred and assigned to UNITED WHOLESALE MORTGAGE, LLC, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Winston County Courthouse at Double Springs, Alabama during the legal hours of sale on May 19, 2026, the following described real estate, situated in Winston County, Alabama, to-wit:
The East 1/2 of Lots 1 and 2 in Block 3 in the R.A. Kelley Addition to the City of Haleyville, Alabama as recorded in Deed Book 72 at Page 599, and being in the Northeast 1/4 of the Southeast 1/4 of Section 30, Township 9, Range 10 West, in Winston County, Alabama.
The property herein conveyed and described by the survey of Charles F. Garrard, Registered Land Surveyor No. 20354, dated December 8, 2004, the survey description being set out in this deed in aid of this conveyance, in addition to the aforesaid description and not for the purpose of limiting the aforesaid description, but for the purpose of aiding and clarifying said description and is described by the aforesaid survey as follows:
The East 1/2 of Lots 1 and 2 Block 3 of the Kelly Addition of Haleyville, Alabama as recorded in Deed Book 72 Page 599 in the Office of the Probate of Winston County, Alabama and being described as follows: Commence at an iron pin found and purported to be the Northwest corner of said Lot 2 Block 3; thence North 84° 44 minutes, 59 seconds East, 91 feet to an iron pin set this being the point of beginning of the tract herein described; thence continue North 84°, 44 minutes, 59 second East, 90.99 feet to the point on the Western right of way of Newburg Road; thence South 3°, 0 minutes, 0 seconds East, along said right of way for a distance of 100 feet to the point of the intersection of the West right of way of Newburg Road with the Northern right of way of 29th Street; thence run South 84°, 46 minutes, 16 seconds West, along said Northern right of way of 29th Street for a distance of 90.50 feet; thence leaving said Street North 3°, 16 minutes, 41 seconds West, 99.95 feet back to the point of beginning.
This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described
property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.

The Financial Crimes Enforcement Network (“FinCEN”), a bureau of the U.S. Department of Treasury, now requires the collection, certification and reporting of certain information relating to non-financed transfers of real property to legal entities and/or trusts, which such information the successful bidder(s) shall be expected to provide to the auctioneer at the time of the subject sale. Interested bidders with questions regarding the necessary information to be provided are hereby directed, generally, to FinCEN’s website and, more specifically to the FinCEN Real Estate Report located in the forms bank thereof. The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded.
