FORECLOSURE SALE
WHEREAS, default has occurred in the performance of the covenants terms and conditions of that mortgage from Shirley Frink a/k/a Shirley M. Frink f/n/a Shirley Mae Cooper an unmarried person, to BankFirst Financial Services, successor by merger to Traders and Farmers Bank, dated July 28, 2018 and recorded in the Office of the Judge of Probate of Winston County, Alabama on July 31, 2018, in Mortgage Volume 630 at Page 46; and
ALSO, that certain Mortgage from Shirley Frink a/k/a Shirley M. Frink f/n/a Shirley Mae Cooper an unmarried person, to BankFirst Financial Services, successor by merger to Traders and Farmers Bank, dated June 25, 2016 and recorded in the Office of the Judge of Probate of Winston County, Alabama on June 30, 2016, in Mortgage Volume 608 at Page 606; and
BankFirst Financial Services, successor by merger to Traders and Farmers Bank, as mortgagee, having declared all of the indebtedness secured by said mortgage due and payable and such default continuing, notice is hereby given under and by virtue of the power of sale contained in said mortgage, that BankFirst Financial Services, successor by merger to Traders and Farmers Bank, as mortgagee, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Double Springs, Winston County, Alabama during the legal hours of sale (between 11 a.m. and 4 p.m.) on the 7th day of March, 2023, the following property, situated in Winston County, Alabama together with hereditaments and appurtenances there unto belonging and all buildings, structures, fixtures and other improvements now or hereafter existing, erected or installed thereon to-wit:

THENCE NORTH A DISTANCE OF 728 FEET TO AN IRON STAKE MARKING THE NW CORNER OF THE DEE SIMMONS PROPERTY FOR A POINT OF BEGINNING: BEGINNING AT SAID STAKE PROCEED EAST A DISTANCE OF 242’8” TO THE WEST RIGHT OF WAY LINE OF LYNN-NAUVOO PAVED ROAD; THENCE NORTH ALONG RIGHT OF WAY LINE A DISTANCE OF 1932 FEET TO A STAKE 132 FEET DUE SOUTH OF THE NW CORNER OF THE NW ¼ OF THE SE ¼ OF SECTION 16, TOWNSHIP 12 RANGE 9 WEST. FROM THIS STAKE PROCEED SOUTH ALONG THE WEST LINE OF THE NW ¼ OF THE SE ¼ AND THE WEST LINE OF THE WEST LINE OF THE SW ¼ OF THE SE ¼ BEING IN SECTION 16, TOWNSHIP 12, RANGE 9 WEST TO THE POINT OF BEGINNING. SITUATED IN WINSTON COUNTY, ALABAMA TOGETHER WITH HOUSE AND APPURTENANCES THEREON. MINERAL RIGHTS EXCEPTED.

A PARCEL OF LAND CONTAINING 20 ACRES MORE OR LESS AND LYING IN THE WEST ½ OF THE SE ¼; BEGINNING AT THE SE CORNER OF THE N ½ OF SW ¼ OF SE ¼, SECTION 33, TOWNSHIP 11, RANGE 9; THENCE NORTH ALONG THE EAST BOUNDARY LINE 970 FEET MORE OR LESS TO THE SE CORNER OF THE WILLIAM BURRELL PROPERTY; THE-NCE WEST ALONG THE SOUTH LINE OF THE BURRELL PROPERTY 1000 FEET MORE OR LESS TO THE NE CORNER OF THE FLOYD MARTIN PROPERTY; THENCE SOUTH 970 FEET MORE OR LESS TO THE SOUTH LINE OF THE NORTH ½ OF SW ¼ OF SW ¼; THENCE EAST ALONG SAID SOUTH LINE 1000 FEET MORE OR LESS TO THE TRUE POINT OF BEGINNING. A PARCEL OF LAND IN THE SE ¼ OF THE NW ¼ OF SECTION 33, TOWNSHIP 11, RANGE 9 MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGIN ON THE EAST LINE OF SAID FORTY AT A POINT 110 FEET NORTH OF THE SE CORNER THERE- OF; THENCE DUE WEST TO THE WEST LINE OF SAID FORTY; THENCE NORTH ALONG SAID WEST LINE A DISTANCE OF 242 FEET; THENCE DUE EAST TO THE EAST LINE OF SAID FORTY; THENCE SOUTH ALONG SAID EAST LINE A DISTANCE OF 242 FEET TO THE POINT OF BEGINNING. ALL BEING IN SECTION 33, TOWNSHIP 11 SOUTH, RANGE 9 WEST. MINERAL AND USING MINING RIGHTS EXCEPTED.

Said legal description being controlling, however the property is more commonly known as County Road 385 and County Road 59, Nauvoo, Alabama; Parcel ID 67-14-08-33-0-000-010.000; 67-17-05-16-0-000-032.000; 67-14-08-33-0-00-023.002.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, and any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record, including, but not limited to, those superior to said mortgage first set out above.
Said property will be sold on an “AS-IS” basis without any representation, warranty or recourse against the above-named or the undersigned. This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure. This sale is subject to postponement or cancellation.
