MORTGAGE
FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain mortgage and security agreement executed by DEAN VON BRADFORD, a single person, on the 4th day of November 2020, to 21ST MORTGAGE CORPORATION, as recorded in Mortgage Book 659, Page 254, in the office of the Probate Judge of Winston County, Alabama; 21ST MORTGAGE CORPORATION, as Mortgagee, by reason of such default having declared all of the indebtedness secured by said mortgage and security agreement due and payable and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage and security agreement, and as authorized by Section 7-9A-604(a)(2) of the Code of Alabama of 1975 as amended, 21ST MORTGAGE CORPORATION, as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in the City of Double Springs, Winston County, Alabama, during the legal hours of sale on April 6, 2023, the following described real and personal property situated in Winston County, Alabama, to-wit:
Commence at an iron pin found and purported to be the Southeast corner of Section 5, Township 9 South, Range 10 West, Winston County, Alabama; thence South 1 degree 29 minutes 44 seconds West 131.95 feet to a nail and bottle cap set in the center of a paved county road; thence along the center of said road North 13 degrees 33 minutes 10 seconds West 152.01 feet to a nail and bottle cap set at the Point of Beginning for the property herein described; thence leaving said road North 88 degrees 29 minutes 39 seconds West 945.65 feet to an iron pin set; thence North 1 degree 20 minutes 08 seconds West 333.00 feet to an iron pin set on the South margin of a paved county road; thence along said margin South 83 degrees 37 minutes 16 seconds East 896.11 feet to a railroad spike found in the center of a paved county road; thence along the center of said road South 13 degrees 36 minutes 45 seconds East 265.66 feet to the point of beginning.
INCLUDING a security interest in one (1) 2020 Southern Energy 28’ x 60’ manufactured home,
Serial No. SOU14569ALAB;
together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
