MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by a certain Mortgage made by McAlister Logging LLC, an Alabama limited liability company (“Mortgagor”), in favor of Community Spirit Bank (“Mortgagee”), dated December 18, 2017 and recorded on January 8, 2018, in Mortgage Book 805, Page 191 in the Probate Office of Franklin County, Alabama and as Amended and Restated on December 1, 2025, and recorded on December 11, 2025, in Mortgage Book 2025, Page 9782 in the Probate Office of Winston County, Alabama (the “Mortgage”), the undersigned Mortgagee, as mortgagee, under and by virtue of the power of sale contained in the Mortgage, will sell at public outcry to the highest bidder for cash in front of the main entrance of the Winston County, Alabama, Courthouse in the City of Double Springs, Winston County, Alabama, on the 27th day of May, 2026, during the legal hours of sale, the following described real estate situated in Winston County, Alabama, to-wit:
THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF FRANKLIN AND WINSTON STATE OF ALABAMA, AND IS DESCRIBED AS FOLLOWS:
Tract I
The N ½ of the SW ¼ of the NE ¼ of Section 24, Township 7 South, Range 11 West, lying East of Baker Road less and except the South 440 feet and also less and except
beginning at the intersection of North line of said 40 and Baker Rd.; thence Southerly along said Rd 100 feet; thence East 150 feet; thence Northerly 100 feet; thence Westerly 150 feet to the point of beginning, lying in Franklin County, Alabama.
Tract II
The N ½ of the following described property; All that portion of SW ¼ of NE ¼ of Section 24, Township 7, Range 11 West, which lies Easterly of road which connects the Mt. Olive-Enterprise Road and Cherry Hill Road and that portion of the SE ¼ of the NW ¼ of Section 24, Township 7, Range 11 West which lies Easterly of the said road, lying in Franklin County, Alabama.
LESS AND EXCEPT: The North 220 feet of uniform width and the South 220 feet of uniform width of the above described property.
Tract III
Begin at the SE corner of Section 28, Township 9, Range 9, thence West along said South section line 735 feet, more or less, thence northerly 900 feet, more or less to paved road, thence easterly along south R/W of said road, 340 feet, more or less, thence SE 715 feet to a point on East line of Section, thence South 485 feet, more or less, to point of beginning, lying in Winston County, Alabama.
Together with all rights, privileges, easements, tenements, interests, improvements, and appurtenances
thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
This property will be sold on an “as is, where is” basis, subject to any easements,
encumbrances,
and and exceptions reflected in the Mortgage and those contained in the records of the Office of the Judge of Probate of the County where the above-described
property is situated. This property will be sold without warranty or recourse, expressed or implied, as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
This sale is made for the purpose of paying the indebtedness secured by the Mortgage, as well as the expenses of foreclosure.
The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
