Pursuant to the provisions of the Alabama Environmental Management Act, Ala. Code §§22-22A-1 to 22-22A-17, as amended, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Rock Creek Stone, LLC., the owner/operator of a limestone crushing, screening, and conveying facility in Addison, Winston County, Alabama.
The violations consisted of failure to apply for and maintain an Air permit before construction, operating without an Air Permit, and conducting surface mining operations without a valid NPDES Permit.
The Department is proposing a civil penalty in the amount of $50,000. The Order, if issued, would require Rock Creek Stone, LLC., to pay the Alabama Department of Environmental Management within 45 days of the effective date, and to comply with the terms, limitations, conditions of ADEM Admin. Code Div. 335-3 and ADEM Admin. Code Div. 335-6.
