MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain Mortgage executed by Scottie DeWayne Wilkins (“Mortgagor”), in favor of Alabama Farm Credit, FLCA (the "Mortgagee"), dated September 15, 2017 and recorded October 5, 2017 in the Office of the Judge of Probate of Winston County, Alabama in Mortgage Book 621, Page 635. Said default continuing, notice is hereby given that the Mortgagee will, under and by virtue of the power of sale contained in the Mortgage, offer for sale at public outcry to the highest bidder for cash during the legal hours of sale on July 3, 2019, at the main entrance to the Courthouse of Winston County, Alabama, the following described Real Property situated in Winston County, Alabama (the "Real Property"), to wit:
A parcel of land lying in the Southwest Quarter of the Northwest Quarter of Section 10, Township 10 South, Range 6 West, Winston County, Alabama, being more particularly described as follows:
BEGIN at the Northeast corner of the Southwest Quarter of the Northwest Quarter of said Section 10, Township 10 South, Range 6 West, said point being a found half inch rebar, and run South 1 degree 20 minutes 03 seconds East along the east boundary of said Quarter to Quarter a distance of 657.50 feet to a set half inch rebar; thence run South 88 degrees 48 minutes 43 seconds West a distance of 664.70 feet to a set half inch rebar; thence run North 1 degree 21 minutes 35 seconds West a distance of 657.67 feet to a set half inch rebar; thence run North 88 degrees 49 minutes 34 seconds East a distance of 665.00 feet to the POINT OF BEGINNING. Said parcel contains 10.0 acres, more or less.
ALSO, an easement for ingress, egress and utilities to the above described parcel, said easement lying in the Southeast Quarter of the Northwest Quarter of said Section 10, Township 10 South, Range 6 West, being more particularly described as follows: BEGIN at the Northwest corner of the Southeast Quarter of the Northwest Quarter of said Section 10, Township 10 South, Range 6 West, said point being a found half inch rebar, and run South 1 degree 20 minutes 03 seconds East along the west boundary of said Quarter to Quarter a distance of 50.00 feet to a point; thence run North 88 degrees 49 minutes 34 seconds East a distance of 74.17 feet to the west right of way of Alabama State Highway 74, also known as U.S. Highway 278; thence run North 38 degrees 40 minutes 41 seconds West a distance of 63.03 feet to a point; thence run South 88 degrees 49 minutes 34 seconds West a distance of 35.94 feet to the POINT OF BEGINNING.
The Real Property and improvements will be sold "as is, where is" and subject to any rights of redemption existing under federal law, the laws of the State of Alabama or otherwise.
The sale is subject to ad valorem taxes.
The sale is subject to any easements, encumbrances or other matters of record which take priority over the Mortgage.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. This sale is made for the purpose of paying the indebtedness secured by said Mortgage, as well as the expenses of foreclosure. The Mortgagee reserves the right to bid for and purchase the Real Property and, if it is the successful bidder, to credit its purchase price against the expenses of sale and the indebtedness secured by the Real Property. The Mortgagee reserves the right to sell the property en masse or parcel by parcel, as the Mortgagee deems appropriate. This sale is subject to postponement or cancellation.
