NOTICE OF MORTGAGE FORECLOSURE SALE
Default having been made in the payment of the indebtedness secured by that certain mortgage and security agreement executed by MICHELLE HOWELL and MICHAEL HOWELL, a married couple, on the 28th day of March 2011, to VANDERBILT MORTGAGE AND FINANCE, INC., as recorded in Mortgage Book 556, Page 160, in the office of the Probate Judge of Winston County, Alabama; VANDERBILT MORTGAGE AND FINANCE, INC., as Mortgagee, by reason of such default having declared all of the indebtedness secured by said mortgage and security agreement due and payable and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage and security agreement, and as authorized by Section 7-9A-604(a)(2) of the Code of Alabama of 1975 as amended, VANDERBILT MORTGAGE AND FINANCE, INC., as Mortgagee, will sell at public outcry, for cash to the highest bidder, in front of the Courthouse door, in the City of Double Springs, Winston County, Alabama, during the legal hours of sale on January 22, 2020, the following described real and personal property situated in Winston County, Alabama, to-wit:
A tract of land, lying in the N 1/2 of the NE 1/4 of Section 15, Township 9 South, Range 6 West, Winston County, Alabama, and more particularly described as follows: Beginning at the Northeast corner of the NW 1/4 of NE 1/4, the point of beginning; thence N 89°56’ W along the north line of said NW 1/4 of NE 1/4 a distance of 425.00 feet; thence S 0°12’45” E parallel with the east line of said NW 1/4 of NE 1/4 a distance of 229.50 feet to a capped 1/2” iron pin; thence S 89°56’ E 591.84 feet to a capped 1/2” iron pin at the westerly right of way (80 foot right of way) for County Road 39; thence northerly along said right of way line, having a chord of N 11°14’03” W 234.03 feet to the north line of the NE 1/4 of NE 1/4; thence N 89°56’ W 122.10 feet to the point of beginning. Capped 1/2” iron pins are marked “Gurney L.S. #11083”.
INCLUDING a security interest in one (1) 2011 Clayton manufactured home,
Serial No. CS2012790TNAB;
together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
This property will be sold on an “as is, where is” basis, subject to any easements, encumbran- ces, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the county where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
